How time clock rounding actually works

Rounding happens punch by punch, not to your daily total. Your clock-in gets pulled to the nearest mark on the grid, your clock-out gets pulled to the nearest mark, and your paid time for the day is the gap between the two rounded values. That is the practice 29 CFR 785.48(b) describes: recording starting time and stopping time to the nearest increment.

Take the shift this page loads with. You clock in at 8:58 and out at 5:04, which is 8 hours and 6 minutes, or 8.10 hours. At the quarter hour, 8:58 rounds forward to 9:00 and 5:04 rounds back to 5:00. Paid time is exactly 8.00 hours. Six minutes disappeared, and both ends of the shift contributed: two minutes at the start, four at the end. Five days of that is half an hour a week.

That table is the 7-minute rule. Seven minutes past a quarter mark rounds back, eight minutes past rounds forward, and the furthest any single punch can travel is 7 minutes. Tenth-of-an-hour rounding uses the same idea on a tighter grid: marks every 6 minutes at :00, :06, :12, :18 and so on, with a maximum move of 3 minutes. Five-minute rounding caps the move at two and a half minutes.

Because both punches move independently, a single day can gain and lose at the same time. It also means very short work can vanish. Clock in at 9:02 and out at 9:05 with quarter-hour rounding and both punches land on 9:00, so a 3-minute stretch of work pays 0.00 hours. Try it in the grid above.

One thing this tool leaves out on purpose: unpaid break columns. In most real systems a lunch break is its own pair of punches, and it gets rounded the same way your shift punches do. Run those punches as their own row, or use the timesheet calculator to net breaks out of the week first.

What the FLSA allows, and where the law is heading

The federal baseline is 29 CFR 785.48(b). It lets employers record starting and stopping times to the nearest 5 minutes, the nearest tenth of an hour, or the nearest quarter hour, but the permission comes with a condition: the practice cannot, over a period of time, fail to compensate employees for all the time they have actually worked. Neutrality is the whole test.

The Department of Labor spelled that out in opinion letter FLSA2019-9 (July 2019) with two questions. Is the rounding policy neutral on its face? And does it average out so employees are fully paid for the time they actually work? An employer that can answer yes to both is compliant.

Courts read it the same way. In Corbin v. Time Warner Entertainment-Advance/Newhouse Partnership, 821 F.3d 1069 (9th Cir. 2016), the Ninth Circuit upheld nearest-quarter-hour rounding even though the plaintiff came out $15.02 behind over a year. The part people miss: an individual employee doesn't have to break even. The policy has to be neutral on its face and neutral as applied, in the aggregate, over time.

California is where the ground is moving. In Donohue v. AMN Services, LLC (2021) 11 Cal.5th 58, the California Supreme Court held that employers may not round meal-period punches at all, even neutrally, because the 30-minute meal period is a bright-line entitlement rather than an average. Donohue was narrow on purpose. It decided meal periods and expressly left the general rounding question open.

That open question is Camp v. Home Depot U.S.A., Inc. In October 2022 the California Court of Appeal, Sixth District, held that where an employer captures the exact time an employee worked, it must pay for all of that time; Home Depot had recorded punches to the minute and then rounded each day's total worktime to the nearest quarter hour. The California Supreme Court granted review on February 1, 2023 (No. S277518), which under California practice removed the appellate opinion as binding authority. Briefing finished in 2023. As of 2026 the case has still not been argued and no opinion has issued, and it is now the oldest unargued civil case on the court's docket. Treat the 2022 appellate reasoning as the direction of travel, not as settled statewide law, and be skeptical of any article that tells you the California Supreme Court has ruled on rounding. Several page-one results say exactly that, and it has not happened.

Rounding was invented because manual timecards were painful to total by hand. Systems that capture punches to the second have made that justification thin, and both regulators and courts have noticed.

When rounding stops being neutral

The distinction that matters to you is not size, it is direction. Random variation is what neutral rounding looks like from the inside: 9 minutes in your favor Monday, 6 against you Tuesday, roughly even across a month. That is the system working as 785.48(b) intends.

A systematic direction is different. The clearest example is rounding the clock-in up and the clock-out down, so every shift loses minutes and none ever gains. That is a one-way ratchet, it can never average out, and averaging out is the express condition in the regulation. Grace periods that only apply against you, or a requirement that you be on the floor working before your rounded start time, do the same thing by another route.

Notice what the always-down and always-up settings above do, because they surprise people. Flooring both punches hands you free minutes at the start of the shift and takes them back at the end, so most of the effect cancels and the weekly number stays small. On the default 8:58 to 5:04 shift, always-down and always-up each gain 9 minutes while nearest loses 6. The chip describes which way the punches move, not who comes out ahead.

What to do with a week that lands against you: keep your own punch record, compare it against the stub, and remember that 785.48(b) is written about what happens "over a period of time." One week is a data point, not proof. If the pattern holds across a month or a quarter and always runs one direction, that is the situation the regulation is aimed at, and your state labor agency or the DOL Wage and Hour Division is where complaints go.

One more wrinkle worth knowing: it is usually your rounded hours, not your actual hours, that cross the 40-hour line. Rounding can push you into overtime or pull you out of it. What is the 7-minute rule for time clocks?

It is what nearest-quarter-hour rounding looks like from the employee's side. Every punch gets pulled to the closest :00, :15, :30, or :45. If you're within 7 minutes past a quarter mark, your punch drops back to it; at 8 minutes or more it jumps forward to the next one. Clock in at 8:07 and you're paid from 8:00; clock in at 8:08 and you're paid from 8:15. The same test runs on your clock-out, which is why the rule can pay you for time you didn't work as easily as it can shave time you did.

Is time clock rounding legal?

Under federal law, yes, with conditions. 29 CFR 785.48(b) permits rounding starting and stopping times to the nearest 5 minutes, tenth of an hour, or quarter hour, but only if the practice does not, over a period of time, fail to pay employees for all the time they actually worked. The Ninth Circuit applied that standard in Corbin v. Time Warner (2016) and upheld quarter-hour rounding even though the employee finished the year $15.02 short. The Labor Department's 2019 opinion letter FLSA2019-9 used a two-part test: the policy has to be neutral on its face, and it has to average out in practice. State law can be stricter.

Can my employer always round down?

No. A policy that only ever moves time in the employer's direction cannot average out, which is exactly what 785.48(b) requires. The clearest version of the problem is rounding your clock-in up and your clock-out down: every shift loses minutes and none ever gains. But "always round down on both punches" is a different animal, because flooring your clock-in hands you free minutes at the start of the shift and takes them back at the end, so the two partly cancel. Does rounding apply to each punch or to my total hours?

This calculator rounds each punch, which is the practice 785.48(b) actually describes. Some employers instead add up the exact minutes and round the daily or weekly total. The two produce different answers, and total-hours rounding is what was challenged in Camp v. Home Depot: the company recorded punches to the minute but rounded each day's total to the nearest quarter hour. Is rounding still allowed in California?

Partly, and the rest is unresolved. In Donohue v. Six minutes a day is the number worth remembering, because it is what an 8:58 to 5:04 shift loses to quarter-hour rounding. That is half an hour a week, roughly 26 hours a year, and at $20 an hour about $520. The direction matters more than the size: a policy that lands against you every single day is the pattern 785.48(b) is aimed at, while a policy that gives you 9 minutes one day and takes 6 the next is doing what it's supposed to do.

What is the difference between 5, 6, 10, and 15-minute rounding?

It is how far any single punch can move. Six-minute rounding, also called tenth-of-an-hour, shifts a punch by at most 3 minutes and lines up neatly with decimal payroll (0.1, 0.2, and 0.3 of an hour), which the decimal hours converter shows in detail. Five-minute rounding moves a punch by at most two and a half minutes. Fifteen-minute rounding can move it a full 7 minutes in either direction, which is why it produces the biggest swings. The regulation names 5 minutes, one-tenth of an hour, and one-quarter hour; 10-minute rounding is common in the field but isn't one of the three it lists.

My pay stub hours do not match my punches. What should I do?

Start by getting your own record. Write down your actual punch times for a full pay period and run them through this tool with the increment your employer uses, then compare against the stub.
